D.C. Act 25-47. River East at Grandview Condominiums Property Tax Exemption Congressional Review Emergency Amendment Act of 2023.
AN ACT
To amend, on an emergency basis, due to congressional review, section 47-3503 of the District of Columbia Official Code to provide for an extended real property tax exemption for unit owners of the River East at Grandview Condominiums for the duration of their relocation from the property.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "River East at Grandview Condominiums Property Tax Exemption Congressional Review Emergency Amendment Act of 2023".
Sec. 2. Section 47-3503(c)(4) of the District of Columbia Official Code is amended as follows:
(a) The existing text is designated as subparagraph (A)
(b) A new subparagraph (B) is added to read as follows:
"(B) Notwithstanding subparagraph (A) of this paragraph, a homeowner of a condominium unit at the River East at Grandview Condominiums located at 1262 Talbert Street, S.E., situated in Square 5807, Lots 2047 through 2092, for which application to the Lower Income Homeownership Exemption Program was accepted and approved by the Office of Tax and Revenue, shall continue to receive the real property tax exemption prescribed under this subsection through the conclusion of real property tax year 2023 or the period provided in subparagraph (A) of this paragraph, whichever is later; provided, that the condominium unit was occupied by the household or was the owner's principal place of residence, as applicable, immediately prior to evacuation of the unit.".
Sec. 3. Applicability.
This act shall apply as of February 1, 2023.
Sec. 4. Fiscal impact statement.
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
Sec. 5. Effective date.
This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code § 1-204.12(a)).
