D.C. Law 24-102. Public Emergency Extension Temporary Amendment Act of 2021.

AN ACT

To extend, on a temporary basis, the Mayor's authority to declare a public emergency, and to clarify that the District of Columbia Education Research Practice Partnership may assist its Advisory Committee.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Public Emergency Extension Temporary Amendment Act of 2021".

Sec. 2. Section 7(c-1) of the District of Columbia Public Emergency Act of 1980, effective March 5, 1981 (D.C. Law 3-149; D.C. Official Code § 7-2306(c-1)), is amended to read as follows:

"(c-1) Notwithstanding subsections (b) and (c) of this section, the Council authorizes the Mayor to extend the 15-day March 11, 2020, emergency executive order (Mayor's Order 2020-045) issued in response to the novel 2019 coronavirus (SARS CoV-2) until March 17, 2022. After the extension authorized by this subsection, the Mayor may extend the emergency order for additional 15-day periods pursuant to subsection (b) or (c) of this section.".

Sec. 3. Section 105 of the District of Columbia Education Research Practice Partnership Establishment and Audit Act of 2018, effective March 28, 2019 (D.C. Law 22-268; D.C. Official Code § 38-785.04), is amended by adding a new subsection (e) to read as follows:

"(e) Notwithstanding any other provision of law, the Partnership and its executive director may provide staff support to the Advisory Committee, including the scheduling of meetings and the drafting of documents.".

Sec. 4. Fiscal impact statement.

The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

Sec. 5. Effective date.

(a) This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of Columbia Register.

(b) This act shall expire after 225 days of its having taken effect.

After mayoral review, it was assigned Act No. 24-292 on Jan. 24, 2022, and transmitted to Congress for its review. D.C. Law 24-102 became effective Mar. 15, 2022.
